As one of my girlfriends once said it, "Not my monkeys, not my circus". The case you refer to however isn't so much about the conduct of Cox's subscribers as it is more about Cox neglecting it's responsibilities as outlined under the DMCA. It's a bit of a nuanced thing but if you were to read the court filings the true standing of the case against Cox will start to make more sense.
As for my "user input", unfortunately I know too much to be allowed to share.
How are the ISP's supposed to police the internet for Companies ? That like suing the modem manufactures for anything that happens on the internet.
If people would just take responsibility for their own actions.
