Cisco DPC3825 5ghz band

Recently, I purchased a Cisco DPC3825 modem/router from Cox. The data sheet for this model states that the radio is capable of broadcasting at 2.4ghz and 5.0ghz. Representatives from Cisco and Linksys have advised me that the unit, as shipped, is capable of broadcasting at both frequencies. Yesterday, I set the router up. Overnight, the firmware was updated. In the wireless settings, there is no option for 5ghz. There is a drop down list, but there is only one option: 2.4ghz. If I buy a 3825 from a third party vendor, will the 5ghz frequency be available as an option in the drop down list? Will Cox firmware override the option if it is initially available?

1. What firmware is your Gateway running?

2. What is the FCC ID?

3. Found this in the manual on Cox's site, page 38.
"Radio Band

Select Enabled 2.4GHz (factory default) or Enabled 5GHz
Note: The 5GHz radio band may not be supported on some models."

Have seen this reported on other Cox forums, where (and correct me if I am wrong Cox Mod) Cox dumbed down the firmware to simplify it for the user. I think in this case, since its 2.4 or 5G instead of 2.4 AND 5G, they saw 2.4 as the more likly use. I don't personally agree with that reasoning, but I think that is the reasoning that was given. If you can tell me the firmware and FCC ID though I can atleast tell you if its hardware restricted or Firmware restricted.
