Consistently poor internet speed - how does Cox stay in business without law suites for lying about their service

Paying for Gigablast speed, but consistently speed at house is 1% of the advertised rates. Had the tech out to house multiple times and no change to service speeds result, just excuses about area needing upgrades. How do Cox get past truth in advertising rules with such huge gaps between the ‘paid for service and the actual service provided. Cannot wait for a true competitor to Cox and this questionable business practice.
