Slower Speeds with Cisco DPC3010

I just upgraded from my old Linksys DOCSIS 2.0 to a new Cisco DPC3010 for the faster speeds with DOCSIS 3.0.

My download speed marginally improved to ~25, but my upload speed dropped to ~3.

Is there a way to get a newer firmware pushed to my modem (as mine showed 2009 build date) or does COX need to be contacted that I now have a DOCSIS 3.0 modem?

Tech support was able to provision my modem over the phone. It definitely improved my downloads to ~43 but my upload is still lower than my previous modem; it's at ~3.4 now. 

Maybe my modem will get the firmware update now that it's provisioned and on  the network?

I suggest bypassing the router, power cycling the modem and testing again.

Thanks for the suggestion.  I tried this and the results were near identical, download in the 40's and upload in the 3's

Is your cable straight from the wall to the modem or is there a splitter? If so, I suggest bypassing the splitter and testing again. If not, I suggest swapping the ends of the cable, so what's in the wall put in the modem and vice versa and testing again.

There is no splitter on this line, but I did try changing the wiring.  I installed a new CAT6 Ethernet and a new RG6Q cable.  Also I noticed that from last night to tonight my firmware was updated:

Firmware Name: d3000-v302r125533-120716a-COX.bin
Firmware Build Time: Jul 16 17:16:46 2012

I'm not sure what caused the change, but bottom line; everything is working great! ~59 down and ~6.5 up, thanks for your help!
