Receiving half the bandwidth

Hello, I signed up for service a week ago after moving to town (Las Vegas) I signed up for the Premier internet with speeds up to 50mbs. Now I understand that, and I'm not expecting to be at 50 all the time, but since I got everything activated my speed as been at 26mbs consistently. I haven't seen speed over that all week at any time during the day or night. Paying for up to 50mbs I would expect to see at least in the 40s.

So I've spent the last week going over my whole home network and computers, checking all of my stuff to ensure I don't have something on my end causing trouble. My computer and other devices connected to my network are all the same ones I was using a week before switching and getting 40mbs just fine from my old provider.

The only change in hardware is that I now have the Netgear CG3000d  modem/router that you all provided.  I used to run with a Motorola modem and my own Dlink router.

Checking out the CG3000 I found that has a very simple user interface with basic options. Nothing in there I could find that would be limiting my bandwidth (that I could adjust at least)

I'm pretty savvy with networking so I'm down to 2 conclusions, 1. I am being limited upstream at 26,   2.There may be something off in the wiring in my building. I'm less concerned about the wiring though since my result doesn't fluctuate its been 26mbs every time I've run the test on multiple speed tests including the on here.

I read on some previous posts about similar issues and it seemed like there could be a hang up associated with the user account.

Let me know if there is anything else I missed, any help would be appreciated!

They may have you under the old DOCSIS 2 service code, if thats the case you have to call and get them to switch you to DOCSIS 3. This happened to me and I went from 30mbps to a solid 50mbps. It was a huge fight getting someone on the line who could make the change. That was right after they went to 50mbps though so they may be more familiar with the steps to do it now.

Yep, pretty sure that was it. Check it now.

More and more areas are requiring it now. Pretty soon none of our reps will have any excuse not to do it/know how to do it. 

For the record, to the best of my knowledge, as of today the "Premier" vs. "Premier for DOCSIS 3" dichotomy currently exists in Northern VA/Hampton Roads VA (not Roanoke yet), Rhode Island, Georgia, Florida (both systems), Arizona, Nevada, Baton Rouge/Greater LA (not New Orleans yet), Kansas/Arkansas, and Nebraska/Iowa.

That was it!  My speed is blazing now, 40-50s every time.
