I am having issues with packet loss as well as slow download/ upload speeds not only with an Xbox One (which is a wired connection with a static assigned IP and port forwarded according to Microsoft specifications) but also slower than normal upload and download speeds on our laptop. At any one time there is approximately 3-5 devices connected to the WiFi with the Xbox using a wired connection. My question is would it be beneficial to upgrade the modem to a newer dual band compatible modem or is the packet loss and slower speeds unrelated to the modem?

What model modem/gateway do you have? If your looking for performance, and port forwarding, your alot better off with a stand alone modem and router. If for no other reasons then you can bypass the router to isolate performance issues.
As for your question, whether it will help to upgrade, I can't say without knowing what equipment you currently have. In general, the most stable gateway I have heard of is the CG4500BD.

Currently I am using the cisco dpq3925 (rented through Cox) and while the performance isn't terrible it tends to vary and really was just curious if upgrading would make sense to maximize the service I am already paying for.

If you mean upgrading to a new gateway? Probably not. If your going to upgrade, you would be better off upgrading to a stand alone modem and router IMO. Im surprised the port forwarding isn't disabled on the DPQ3925, in some areas alot of it's features are locked down by Cox firmware.
