Slow internet speeds with Preferred level service

I started to notice it being really slow during the day and only slightly better at night.  Internet speed has never really been a problem no matter what time of day in my area.  Since I noticed the slowdown the last couple of weeks I started running speed tests on the cox internet tools site at various times through the day to see if there was a difference day vs night.  This morning between 9 am and 10 am i was getting download speeds of less than 1 mbps.  I ran more tests throughout the day and typically get about 1-3 mbps.  At midnight tonight i got three tests in a row where i did get 12 mbps but the next 10 tests i am back to 3 mbps.  This is not even close to what i should be getting with the preferred service I believe.  I have called twice and the problem has not been resolved.  I have run the tests with and without my router and still the same results.  

If it helps I have the Arris box for my home phone and internet.

Any help would be greatly appreciated.  Thanks.

Are you sure it's an Arris you have and not a Motorola?

Hi Chris,

Yes.  The label on the back is Arris TM602G/CX - 8 TRK and handles my phone and internet.  It was installed by Cox back in 08 or 09.

I have the exact same problem here in Las Vegas. Tech was here twice and maintenance. My speeds are never higher then 3 mbps and I have preferred. They told me both times they were here that it was the area and not my house or equipment. They changed my modem twice. This has been going on for about 2 months and I'm getting frustrated because I'm not going to pay preferred price for basic service much longer.

Does your modem also have a logs section that is accessible?  If the modem is Cisco branded the logs won't be accessible.
