download speed very slow, upload speed surprisingly high

Lately my internet speeds has been seriously acting up. Here's a snapshot from Cox's speed test.

My download speed is much slower than usual (I usually get around 40-50mbps) and my upload speed is surprisingly fast (I usually get around 20mbps).

I tried removing my cable splitter and for a bit I thought that fixed it (I shot back up to 40mbps download) but within an hour or so it was back to less than 10mbps. Frequently it was as low as 3-4mbps.

The main thing that stands out is the downstream channels not bonding from your logs as well as what is currently showing for the modem but that is not the only thing that would cause it to drop that low. Are you seeing the speeds change through the day or has it been fairly consistent?

It's fluctuated a bit, but it's fairly consistently at around 8-9mbps most of the time. I haven't seen it go above 12mbps except for that one exception I mentioned.

It appears there was a firmware update for the modem sent out and the last reading showing are back in line with the downstream and upstream being corrected. Are you still seeing those results on the speed test?

Last night performance was actually decent, but today it is back to ~12mbps. It's worth noting that my modem shows the exact same firmware it did before - d3000-v302r125533-120716a-COX, built on Jul 16 17:16:46 2012.
